Please read these terms carefully before using Ventsy.
1. About Ventsy
Ventsy Pty Ltd ("Ventsy", "we", "our", or "us") is an online marketplace that connects customers with independent event service vendors. Ventsy is a marketplace platform only — we are not a provider of event services, products, or rentals. Ventsy Pty Ltd is a company registered in Australia.
2. Independent Vendors
All vendors listed on Ventsy are independent businesses. They are not employees, agents, or representatives of Ventsy. Each vendor operates their own business and sets their own pricing, availability, and policies.
3. Contract for Services
The contract for any event service, rental, or product is made directly between the customer and the vendor. Ventsy is not a party to that agreement. By making a booking through Ventsy, you are entering into a direct contractual relationship with the vendor.
4. Limitation of Liability
Ventsy is not responsible for, and expressly disclaims all liability in relation to:
Customers are encouraged to verify vendor credentials, insurance, and licensing before confirming a booking.
5. Vendor Management
Ventsy reserves the right, at its absolute discretion, to remove any vendor from the platform at any time and for any reason, including but not limited to complaints, poor performance, or breach of our vendor terms.
Ventsy may suspend or terminate any vendor or customer account at its discretion, with or without notice.
6. Commission Structure
Ventsy charges a commission of 5% of the booking value (excluding GST), plus GST where applicable. This fee is calculated on the GST-exclusive amount of each booking or sale and is deducted from the booking amount before payout to the vendor.
**Founding Vendor Offer:** Founding vendors who join before 31 December 2026 receive a 5% commission rate for 12 months from approval date.
For vendors registered for GST, listing prices must include 10% GST; the GST component of each booking is passed through to the vendor and is not retained by Ventsy. For vendors not registered for GST, listing prices are treated as GST-free, but Ventsy's commission still includes GST on our service.
Ventsy does not charge customers any platform fees.
7. Refund Policy
Refunds are subject to the individual vendor's cancellation and refund policy. Ventsy does not guarantee refunds on behalf of vendors. If a vendor agrees to a refund, Ventsy will facilitate the return of funds within a reasonable timeframe. In cases of proven vendor misconduct, Ventsy may, at its discretion, assist in facilitating a resolution.
Customers should clarify the vendor's refund policy before completing a booking.
8. Dispute Process
If a dispute arises between a customer and a vendor, we encourage both parties to attempt to resolve the matter directly. If resolution cannot be reached, either party may contact Ventsy Pty Ltd support at support@ventsy.com.au. Ventsy may, at its discretion, act as a neutral facilitator but is not obligated to resolve disputes or provide compensation.
Ventsy's decision on any dispute matter is final.
9. General Limitation of Liability
To the maximum extent permitted by law, Ventsy's total liability to any party in connection with use of the platform shall not exceed the commission amount collected by Ventsy in relation to the specific booking giving rise to the claim. Ventsy is not liable for any indirect, consequential, or special damages.
10. Changes to These Terms
Ventsy may update these Terms and Conditions at any time. Continued use of the platform after changes constitutes acceptance of the updated terms.
11. Governing Law
These Terms and Conditions are governed by the laws of Victoria, Australia. Any disputes are subject to the exclusive jurisdiction of the courts of Victoria.
